Desde que asumió la presidencia en enero, Donald Trump ha priorizado la ejecución de la ley migratoria y la deportación, estableciendo cuotas de arrestos a nivel nacional y provocando un creciente pánico entre las comunidades inmigrantes de Pensilvania.

City Cast Pittsburgh habló con Vanessa Stine, abogada sénior de la ACLU de Pensilvania, para saber qué sucede durante una detención o redada del Servicio de Inmigración y Control de Aduanas qué derechos tienen los inmigrantes independientemente de su estatus legal y cómo los testigos pueden ayudar durante un encuentro con ICE.

Qué Hacer Si…

ICE te detiene en la calle

  • Los agentes de ICE no pueden detener a nadie en la calle sin una razón legal.
  • Si un agente de ICE te detiene y comienza a hacerte preguntas, pregunta si puedes irte.
  • Si el agente dice que sí, aléjate.
  • Si el oficial dice que no y pregunta sobre tu estatus migratorio, puedes ejercer tu derecho a guardar silencio. Dile "Voy a guardar silencio" y no responde ninguna pregunta.
  • Si tienes estatus migratorio legal y ICE te pide un comprobante, como una tarjeta de residencia permanente, debes entregárselo si lo llevas contigo.

ICE llama a tu puerta

  • ICE no puede entrar a tu casa sin una orden judicial firmada por un juez, así que no abre la puerta automáticamente.
  • Pide a los agentes que te muestren la orden, deslizándola por debajo de la puerta o acercándola a la ventana.
  • Verifica que tengan una orden válida. Debe decir "United States District Court" en la parte superior y estar firmada por un juez. El cargo del juez aparecerá debajo de la firma.
  • Los agentes podrían mostrarte un tipo diferente de orden, llamada “orden administrativa”. En la parte superior dirá "Department of Homeland Security, U.S. Immigration and Customs Enforcement". Si solo tienen una orden administrativa, no estás obligado a dejarlos entrar.
  • Puedes decir: "No les doy permiso para entrar. Por favor, váyanse".
  • Infórmate sobre la diferencia entre las órdenes judiciales y administrativas y ve ejemplos de cada una en estos recursos de la ACLU de Pensilvania y del National Immigration Law Center.

Eres testigo de una parada o arresto por parte de ICE

  • Si te sientes seguro al hacerlo, puedes grabar un video del encuentro con ICE. Es legal que los transeúntes graben a los agentes policiales en Pensilvania.
  • Quédate en las aceras públicas y asegúrate de no interferir en el encuentro.
  • No compartas el video públicamente a menos que hayas recibido permiso de la persona o personas afectadas. Es importante respetar su privacidad y autonomía.
  • Los agentes de ICE generalmente no usan cámaras corporales; por eso, tu video podría ser una prueba útil en el caso de inmigración de alguien.

Crees haber visto actividad de ICE, pero no estás seguro

  • Ponte en contacto con Juntos. El grupo local de derechos de los inmigrantes, que puede intentar verificar si se llevó a cabo alguna actividad de ICE. El número es 215-218-9079.
  • No publiques ni compartas nada si es solo un rumor. La información falsa puede ser perjudicial y, lamentablemente, a veces hay personas que difunden información errónea para asustar a los miembros de la comunidad inmigrante.
